The Twinkie Defense

Back in 1978, a young man named Dan White shot and killed Harvey Milk and George Moscone. He lived in San Francisco and murdered both men in what appeared to be cold blood. White had been depressed leading up to the day he killed these men. He said that he had eaten nothing but Twinkies for several days leading up to the event.

At trial, White’s lawyers argued that he didn’t have the mental capacity to know that what he was doing was wrong. He argued that White had ingested so much sugar over the days prior to the murder that it made him insane. This, coupled with his depression, the lawyer argued, made it impossible for him to have the mental capacity to plan a murder.

The jury actually bought his defense. Instead of being sentenced to death, White was convicted only of voluntary manslaughter. The jury found him guilty and sentenced him to eight (8) short years.

The Mirror Defense

This case takes us all the way to Malaysia where a young man was caught red-handed dealing drugs. A 27-year old man was found with 166 kilos of marijuana and a bunch of opium on him. He was charged with drug trafficking – a crime that, in Malaysia, was punishable by death by hanging.

There was plenty of evidence against the defendant, including DNA evidence. However, the defendant happened to have a twin. His twin, who shared the exact same DNA as the defendant, claimed that he was the one who had done the crime.

The jury had no idea who was telling the truth. They had two men who had the same DNA and looked exactly the same. They were so confused that they admitted they didn’t know who had committed the crime. Both men were acquitted and set free.

The Matrix Defense

A woman in Ohio decided one day to kill her landlady. She was charged with murder after shooting the woman to death. At trial, her defense lawyer claimed that she believed she was living in the Matrix – just like in the movie.

The defendant claimed that she believed her landlady was part of a conspiracy to brainwash her and then kill her. She said the conspiracy existed in the matrix and that she would be killed in a computer simulation.

The jury believed her story and found her not guilty by reason of insanity.
